BY USING YOUR ALTIA SYSTEMS INC. HARDWARE PRODUCT YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE ALTIA SYSTEMS ONE (1) YEAR LIMITED WARRANTY (“WARRANTY”) AS SET OUT BELOW.  DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY.  IF YOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT WITHIN THE RETURN PERIOD OF THIRTY (30) DAYS FROM END-USER PURCHASE DATE.

Altia Systems’ obligations for this hardware product are limited to the terms set forth below:

Altia Systems Inc. warrants this Altia Systems-branded hardware product against defects in materials and workmanship under normal use for the period of ONE (1) year from the date of retail purchase by the end-user purchaser (“warranty period”). If a hardware defect arises and a valid claim is received within the warranty period, at its option and to the extent permitted by law, Altia Systems will either (1) repair the hardware defect at no charge, using new or refurbished replacement parts, (2) replace the product with a product that is new or which has been manufactured from new or serviceable parts and is at least functionally equivalent to the original product, or (3) refund the purchase price of the product, provided that the hardware is returned to the point of purchase or such other place as Altia Systems may direct with a copy of the sales receipt or dated itemized receipt; shipping and handling charges may apply except where prohibited by applicable law. When a refund is given, the product for which the refund is given must be returned to Altia Systems and becomes Altia Systems’ property.

In addition, if your Altia Systems hardware product is completely inoperable, that is, it will not turn on when the power button is pressed, and you make a warranty claim within thirty (30) days of retail purchase, Altia Systems will pay the cost of returning your defective hardware product, in the manner specified by Altia Systems.

You may call (408-996-9710) during the hours of 8:00 am to 5:00 pm, PST, Monday-Friday, except holidays, or open an online ticket at go.panacast.com/support/ to get to Altia Systems’ support desk for assistance with returning defective hardware products under warranty and to receive a return material authorization (“RMA”).

You have the choice to purchase Altia Systems’ Advanced Replacement Extended Warranties as follows:

  • 2-Year Extended Warranty $99
  • 3-Year Extended Warranty $139

You may purchase the Advanced Replacement provided that the existing warranty on that unit (either the initial warranty or an Advanced Replacement Extended Warranty purchased the previous year) has not lapsed.  If you purchase the Advanced Replacement, the warranty remains in place for one (1) year from the date your existing warranty lapses.  After you contact the Altia Systems support desk and receive a RMA from Altia Systems for your defective unit, Altia Systems will ship to you an advance replacement of the same type within 2-5 business days after the RMA is issued.  You must return the defective unit to Altia Systems within 14 days after delivery of the replacement unit.  Altia Systems will charge you for the new unit if you fail to return the defective unit within 14 days of delivery of the replacement unit.

EXCLUSIONS AND LIMITATIONS

This Limited Warranty applies only to hardware products manufactured by or for Altia Systems, including the PanaCast Camera.  The Limited Warranty does not apply to any non-Altia Systems hardware products or any software, even if packaged or sold with Altia Systems hardware.  Manufacturers, suppliers, or publishers other than Altia Systems may provide their own warranties to the end-user purchaser but Altia Systems, in so far as permitted by law, provides such third party products “as is”.  Software distributed by Altia Systems, with or without the Altia Systems brand name, is not covered under this limited warranty.

Altia Systems does not warrant that the operation of the hardware product will be uninterrupted or error-free. Altia Systems is not responsible for damage arising from failure to follow instructions relating to the product’s use.

This Warranty does not apply: (a) to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic; (c) to damage caused by use with another product; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake, or other external causes; (e) to damage caused by operating the Altia Systems product outside Altia Systems’ published guidelines; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Altia Systems; (g) to an Altia Systems product that has been modified to alter functionality or capability without the written permission of Altia Systems; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the Altia Systems product, or (i) if any serial number has been removed or defaced from the Altia Systems product.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.  Altia Systems’ responsibility for hardware defects is limited to repair, replacement service, or refund as determined by Altia Systems in its sole discretion.  TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS, OR WARRANTIES. ALTIA SYSTEMS EXPRESSLY DISCLAIMS ANY STATUTORY OR IMPLIED WARRANTY OR CONDITION, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SATISFACTORY QUALITY, NON-INTERFERENCE, OR ACCURACY OF INFORMATIONAL CONTENT, OR ARISING FROM A COURSE OF DEALING OR TRADE PRACTICE, TO THE EXTENT ALLOWED BY APPLICABLE LAW. To the extent an implied warranty cannot be excluded, such warranty is limited in duration to the express warranty period. No warranties, whether express or implied, will apply after the expiration of the limited warranty period. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.

No Altia Systems reseller, agent, or employee is authorized to make any modification, extension or addition to this warranty.

ALTIA SYSTEMS INC. SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE OR DATA, OR COMMERCIAL LOSS EVEN IF ALTIA SYSTEMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental, or consequential damages, so the above limitation or exclusion may not apply to you.

ADDITIONAL NOTES ON WARRANTY

When contacting Altia Systems via telephone, other charges may apply depending on your location.  When calling, an Altia Systems representative will help determine whether your product requires services and if it does, will inform you as to how Altia Systems will provide it.  You must assist in diagnosing issues with your product and follow Altia’s warranty processes.

Altia Systems may restrict service to the fifty states of the United States of America and the District of Columbia, and provide warranty service (i) at an Altia Systems Retail location, where service is performed at the location, or at an Altia Systems repair service location for service or (ii) by sending you prepaid way bills (and if you no longer have the original packaging, Altia Systems may send you packaging material) to enable you to ship the product to Altia Systems’ repair service location for service.

Service options, parts availability, and response times may vary.  Service options are subject to change at any time.  In accordance with applicable law, Altia Systems may require that you furnish proof of purchase details and/or comply with registration requirements before receiving warranty service.

Note that in the European Union, any warranty period less than two years shall be increased to two years.
